Section 1 - Name

This organization shall be known as the New Brunswick Branch of the Canadian Institute of Public Health Inspectors.

Section 2 - Structure

The New Brunswick Branch CIPHI shall be composed of members of the Canadian Institute of Public Health Inspectors who submit application for membership in the N.B. Branch.

Section 3 - Membership

The Branch will observe and be governed by the Constitution and By-Laws of the Canadian Institute of Public Health Inspectors with regard to membership.

Being a By-Law to amend the previous No. 1, 1953 By-Law, setting up the Constitution of the Institute.

BE IT ENACTED as a By-Law of the Canadian Institute of Public Health Inspections as follows:

That the categories of memberships and membership rights be as follows:

Section 1 - Regular Membership

Persons may be eligible for Regular Membership if they hold the Certificate in Sanitary Inspection (Canada), the Certificate in Public Health Inspection (Canada), or if they possess those qualifications acceptable to a three-fourths vote of the entire Executive Council of the Canadian Institute of Public Health Inspectors or as determined by an Annual General Meeting.

Regular Members shall have full voting rights and the right to hold office.

Section 2 - Fraternal Membership

Fraternal membership may be granted to any person who does not hold the C.P.H.I.(C) or the C.S.I.(C) and who is employed in a profession that shares a common interest in the field of environmental health and wishes to contribute towards a unified voice on issues of common interest.

Section 3 - International Membership

International membership may be granted to any person residing outside of Canada who does not hold the C.P.H.I.(C) or the C.S.I.(C) and who shares a common interest in the field of environmental health and wishes to contribute towards a unified voice on issues of common interest.

Section 4 - Affiliate Membership

Individuals or non-profit organizations may be eligible for Affiliate Membership if they share a common interest in the field of environmental health and wish to work toward a unified voice on issues of common interest. Affiliate Members shall have neither voting rights nor the right to hold elected office.

Section 5 - Student Membership

Student Members shall be persons studying for the Certificate in Public Health Inspection (Canada) and approved as such by the Board of Certification of Public Health Inspectors of the Canadian Institute of Public Health Inspectors or such other Public Health Inspector qualification as the Institute may approve. They shall have neither voting privilege nor the right to hold office, but may attend Meetings and partake in all discussions.

Any Student Member who successfully obtains his/her C.P.H.I.(C) entitling him/her to full membership shall submit a completed membership application form, including his/her Certificate Number, and dues to the National Executive Secretary-Treasurer/Executive Director.

Section 6 - Honorary Membership

Honorary Membership may be conferred by majority vote at an Annual General Meeting as a mark of distinction to persons not holding qualifications as a Public Health Inspector, but who have made a noteworthy contribution to the Science of Sanitation. Honorary members shall pay no fees and shall have no voting privileges. They shall not be entered upon the Register of Members of the Institute and shall not be under any liability for the debts and liabilities of the Institute. They shall remain Honorary Members during the pleasure of the Institute.

Those persons voted to Honorary Membership prior to the passing of this By-Law shall be recognized under the appropriate Section of this Revised By-Law.

Section 7 - Life Membership

(a) Life membership may, subject to the provisions of Subsection (c) of this Section, be conferred by vote at the Annual General Meeting to qualified Public Health Inspectors who are Members of the Institute and who have made a noteworthy contribution to the advancement of Sanitary Science and/or the purposes of the Institute. Life Membership may be granted to persons still practicing. Such Life Membership shall carry voting privileges and the right to hold office, but no obligation to pay fees.

(b) No more than one Life Member shall be elected at any Annual Meeting and the total number of living Life Members shall not exceed three (3) percent of the membership, as determined from the current report of the executive Secretary-Treasurer/Executive Director.

(c) The National Executive Council shall consider the criteria of all nominees and shall forward the nominations along with their recommendations to the Annual General Meeting to be voted upon in accordance with subsection (a) of this section.

(d) The nominator of a Member proposed for Life Membership shall forward with the nomination a citation setting forth the eligibility criteria of the nominee pursuant to Sub-Section (a) of this Sections.

(e) Nominations for Life Membership shall be mailed or delivered to the Executive Secretary-Treasurer / Executive Director so as to be in his/her possession sixty (60) days prior to the Annual Meeting.

Section 8 - Retired Membership

A. Any member who upon retirement from active employment through age, health or disability and is eligible for some form of pension and wishes to continue membership in the C.I.P.H.I. may apply in writing to their Branch to continue such membership. The applicant shall advise the Branch and the Executive Secretary-Treasurer/Executive Director as to the effective date of retirement. A Retired Member shall have full voting rights and the right to hold office.

B. Any member who has retired from active employment from one employing agency from which the member is receiving or is eligible to receive a pension, and who now is working as a full-time employee for another agency where the pre-requisite for employment is the C.P.H.I. (C), shall not be considered for retired membership.

Section 9 - Corporate Membership

Corporate Members shall be persons or corporations who derive benefits of information, education and self-promotion through membership in the Institute. Such Members shall have neither voting privileges nor the right to hold office nor shall such members be responsible for the debts and liabilities of the Institute. Such Membership shall be at the pleasure of the Institute.

Section 4 - Branch Officers and Elections

(a) The officers of the Branch shall consist of:

1. A President
2. A Vice President
3. A Secretary
4. A Treasurer
5. Two or more Branch Councilors.

(b) Each Branch Officer will have a two year term of office and elections shall be held at a Branch Annual General Meeting. Newly elected officers will assume office immediately after the meeting at which they were elected.

(c) The President, Vice President and Secretary shall be elected in each year ending in an even number. The Treasurer and two councilors shall be elected in each year ending with an odd number.

Section 5 - Committees

1) The following shall be standing Committees of the Branch:

A) Membership
B) Education
C) Nominations

2) Special Committees may be formed from time to time in order to carry out any work, which may be deemed necessary. Once such a Committee has completed its task, it shall cease to exist.

3) The New Brunswick Branch President shall be ex-officio member of all Branch Committees.

Section 6 - Audit of Accounts

At each Branch Annual General meeting, auditors shall be appointed and shall hold position until the next Annual General meeting. These auditors shall audit the books of the Branch and present a report to the Annual General meeting.

Section 7 - Delegate to Annual National Conference

1) The President shall automatically be the official Branch delegate to the Annual National Conference.

2) The Executive Committee shall, at a meeting prior to the Annual National Conference, designate the amount of money to be granted to the President or his/her delegate for expenses in attending the Conference.

Section 8 - Duties of Officers

1) The President shall:
a) be the presiding officer at all Branch meetings
b) be one of the two signing officers for the Branch
c) be the official delegate to the Annual National Conference
d) submit written reports to both the annual National Conference and the AGM of the Branch, outlining the activities of the Branch during the year.
e) be a National Vice President, unless otherwise stated in the National Constitution.
f) have the power to delegate duties and responsibilities as he/she feels are appropriate and in the best interest of the branch.

2) The Vice President shall:
a) Be the presiding officer at a Branch, or General meeting in the absence of the President.
b) Assume the position of President should the Branch President become National President
c) Assist the President in carrying out the Branch activities
d) Be chairperson of the Education Committee.

3) The Secretary shall:
a) Have custody of the records of the Branch
b) Record the minutes at all Branch meetings
c) Conduct the correspondence for the Branch
d) Distribute to all Branch members the minutes of the Executive meetings as well as the minutes of the General Branch meetings.

4) The Treasurer shall:
a) Be one of the two signing officers for the Branch
b) Receive and deposit Branch funds into the Branch's bank account
c) Keep the accounts
d) Be chairperson of the Membership Committee.
e) Collect membership fees, issue receipts, and submit National's share to national office.
f) Provide written reports at each Executive Committee Meeting and all Branch AGM's.

5) The councilors shall:
a) Be part at the education committee and be responsible through the chairperson to provide content and speakers for the Annual Branch Educational Conference.
b) Be part at the Membership Committee to recruit new members and retain current members.
c) Keep members informed on Branch Activities.

6) The past President shall:
a) Be chairperson of the Nominating Committee. For the sole purpose of assuring that all offices will be filled, the Nominations Committee shall prepare a slate of officers listing nominees for the various offices, after having first obtained their consent to this nomination.
b) Be co-chairperson of the Membership Committee, assisting recruiting of new members, and the retaining of current members.
c) Develop and maintain a membership package for new members.

Section 9 - Branch Executive Committee

1) The President, Immediate Past-Branch President, Vice-President, Branch Secretary, Branch Treasurer and Branch Councilors shall together form a Branch Executive.

2) Meetings shall be held at the call of the President or at the written request of four (4) members of the Branch Executive. There shall be a minimum of three Executive Committee meetings held between Annual General meetings. One or more of these meetings may be teleconference.

3) Meetings shall be held to conduct the business of the Branch including the passing of accounts for payment.

4) At Executive Committee meetings, the chairperson of each committee shall present a written report on the committee's activities.

Section 10 - Branch General Meetings

Any General Meeting - a quorum shall be 25% of the membership.

Branch General meetings shall be held in order to conduct Branch business, and, in the case of the Annual General meeting, to hold the election of officers.

Section 11 - Quorums

Executive Committee meetings - a quorum for the Executive Committee shall be a majority of its members and the majority shall be maintained throughout the meeting.

Section 12 - Voting

1) Each member entitled to vote according the Constitution and By-laws of the Canadian Institute of Public Health Inspectors shall have one vote and is eligible to hold office.
2) The President shall not vote except in the case of a tie where he/she may cast a deciding vote.
3) Members not in attendance may vote by proxy on By-Law changes.
4) At the Annual General meeting the President shall appoint two or more scrutineers if necessary who shall count the ballots and advise the President of the election results.

Section 13 - Points not covered

All points of procedure not covered by these Branch By-laws shall be governed by the Constitution and By-laws of the Canadian Institute of Public Health Inspectors.

Section 14 - By-Laws Amendments

By-laws shall not be amended except at an Annual General Meeting.

Future changes to the by-laws shall be sent out to the membership 30 days prior to an Annual General Meeting.

Proxy votes shall be used to enable each member to vote on proposed changes.

A ¾ majority of all members voting is all that is required for acceptance of amendments.

Section 15

All motions of the New Brunswick Branch records which are inconsistent with these By-Laws are hereby repealed.

L'Institut Canadien des Inspecteurs en Santé Publique Section du Nouveau-Brunswick Constitution et Règlements

Section 1 - Nom

Cet organisme sera connu sous le nom de la section du Nouveau-Brunswick de l'Institut Canadien des Inspecteurs en Santé Publique.

Section 2 - Structure

La section du Nouveau-Brunswick de l'ICISP sera formée de membres de l'Institut Canadien des Inspecteurs en Santé Publique qui font application pour adhérer à la section du N.-B.

Section 3 - Adhésion

La section suivra et sera gouvernée par la Constitution et les Règlements de l'Institut Canadien des Inspecteurs en Santé Publique quant à l'adhésion.

Étant un règlement qui modifie le précédent No 1, règlement 1953, établissant la Constitution de l'Institut.

Qu'il soit dûment fait règlement de l'Institut Canadien des Inspecteurs en Santé Publique ce qui suit:

Que les catégories d'adhésion et les droits des membres soient:

1 Membres réguliers

Peuvent être éligibles à devenir membres réguliers les personnes possédant un Certificat d'inspection sanitaire (Canada), un Certificat d'Inspection en Hygiène Publique (Canada), ou les qualifications acceptables à ¾ des votes du Conseil Exécutif de l'Institut Canadien des Inspecteurs en Santé Publique.

Les membres réguliers ont droit de vote et pourront être membres de l'exécutif.

2 Membres fraternels

Une adhésion fraternelle peut être attribuée à toute personne ne détenant pas le CIHP(C) ou CIS(C) et qui est employé(e) dans une profession ayant un intérêt commun avec la Santé environnementale et qui veut contribuer envers une voix unie sur des sujets d'intérêt commun.

3 Membres internationaux

Une adhésion en tant que membre international peut être attribuée à toute personne résidant à l'extérieur du Canada, qui ne détient pas le CIHP(C) ou le CIS(C), et qui partage un intérêt commun avec la Santé environnementale et qui veut contribuer envers une voix unie sur des sujets d'intérêt commun.

4 Membres affiliés

Les individus ou les organisations à but non-lucratif peuvent être éligibles pour un adhésion en tant que membre affilié s'ils ont un intérêt commun avec la Santé environnementale et veulent contribuer envers une voix unie sur des sujets d'intérêt commun. Les membres associés n'auront pas droit de vote et ne pourront pas être membres de l'exécutif.

5 Membres étudiants

Les membres étudiants seront des personnes qui étudient pour le CIHP(C) et reconnu(e)s en tant que tel par le conseil de Certification des Inspecteurs en Hygiène Publique de l'Institut Canadien des Inspecteurs en Santé Publique, ou pour tout autre qualification d'Inspecteur en Santé publique que l'Institut approuvera. Ces membres n'auront pas de privilèges de vote, ou de droit d'être membre de l'exécutif, mais pourront assister aux réunions et participer aux discussions. Tout membres étudiant qui obtient son CIHP(C), lui donnant droit d'être membre régulier, devra présenter une application remplie, incluant son numéro de certificat, et ses frais d'adhésion, au Directeur Exécutif National.

6 Membres honoraires

L'adhésion en tant que membre honoraire pourra être accordée, suivant un vote majoritaire à toute Assemblée Générale Annuelle, en tant que marque de distinction à toute personne ne détenant pas les qualifications d'inspecteur en santé publique, mais qui a contribué de façon remarquable aux Sciences de la Salubrité. Les membres honoraires ne paieront pas de frais d'adhésion, et n'auront pas de droits de vote. Ces membres ne seront pas admissibles à la Liste des Membres de l'Institut, et ne peuvent être tenus responsables pour les dettes de l'Institut. Ces membres demeureront membres tant que l'institut le voudra.

Les personnes nommées membre honoraire avant ce règlement seront reconnus sous la section appropriée de ce règlement révisé.

7 Membres à vie

L'adhésion à vie peut, sujet aux provisions de la sous-section (c), être accordée par un vote de l'Assemblée Générale Annuelle, à tout Inspecteur de Santé Publique qualifié qui est Membre de l'Institut, et qui a contribué de façon remarquable à l'évolution des Sciences de la Salubrité. L'adhésion à vie peut être accordée à des membres encore employés. Une telle adhésion comporte des droits de vote et d'être membre de l'exécutif, mais ne comporte pas de frais d'adhésion. Pas plus d'une personne peut être nommée membre à vie à chaque Assemblée Générale Annuelle, et le nombre total de membres à vie ne dépassera pas trois (3) pour cent du total des Membres. Le Conseil Exécutif National prendra en considération les critères de tous les candidats et avanceront les candidatures ainsi que leurs recommandations à l'Assemblée Générale Annuelle, afin de tenir un vote d'après la sous-section (a) de cette section. La personne faisant la nomination d'un Membre en tant que membre à vie avancera avec la candidature, une citation décrivant les critères d'éligibilité du candidat d'après la sous-section (a) de cette section. Les nominations pour membre à vie devront être postées ou livrées au/à la Directeur(trice) exécutif(ve) afin d'être en sa possession soixante (60) jours avant l'Assemblée annuelle.

8 Membres à la retraite

A Tout membre qui, à sa retraite due à l'age, la santé ou un handicap, et qui est en mesure de recevoir une pension, et qui désire continuer son adhésion à l'ICISP, peut appliquer par écrit à sa Section afin de continuer son adhésion. La personne qui applique en avisera la Section et le/la Directeur(trice) Exécutif(ve) de la date de sa retraite. Un membre à la retraite aura droit de vote et pourra être membre de l'exécutif.

B Tout membre qui, suite à sa retraite d'une agence qui lui fournit une pension, mais qui travaille à temps plein ou partiel pour une autre agence qui requiert la désignation C.I.H.P.(C), ne pourra être considéré en tant que Membre à la retraite.

9 Membre corporatif

Les membres corporatifs seront des personnes ou des corporations qui obtiennent des bénéfices ou des informations, de l'éducation et de la promotion par l'entremise d'une adhésion à l'Institut. Ces membres n'auront pas de droit de vote, et ne pourront pas être membres de l'exécutif; de plus, ces membres ne peuvent être tenus responsables des dettes de l'Institut. De telles adhésions seront au gré de l'Institut.

Section 4 - Officiers de la Section et Élections

(a) Les officiers de la Section seront:

Un(e) Trésorier(ère)
Au moins deux(2) Conseillers(ères)

Chaque Officier de la Section servira pendant deux(2) ans et des élections seront tenues à chaque Assemblée Générale Annuelle. Les officiers nouvellement élus assumeront leur poste immédiatement après l'assemblée à laquelle ils(elles)ont été élu(e)s. Le(la) Président(e), le(la) Vice-Président(e) et le(la) secrétaire seront élu(e)s pendant les années paires. Le(la) Trésorier(ère) et les deux Conseiller(ère)s seront élu(e)s pendant les années impaires.

Section 5 - Comités

(1) Les comités suivants seront des comités permanents de la Section:

A) Adhésion
B) Éducation
C) Nominations

(2) Des comités spéciaux pourront être formés de temps à autre, afin de poursuivre tout travail jugé nécessaire. Lorsqu'un tel comité a accompli son travail, il cessera d'exister.

(3) Le Président de la Section du Nouveau-Brunswick sera membre ex-officio de tous les comités de la Section.

Section 6 - Vérification des Comptes

À chaque Assemblée Générale Annuelle, des vérificateurs seront nommés et garderont ce poste jusqu'à la prochaine Assemblée Générale Annuelle. Ces vérificateurs vérifieront les comptes de la Section, et présenteront un rapport à l'Assemblée Générale Annuelle.

Section 7 - Délégué à la Conférence Nationale Annuelle

(1) Le(la) Président(e) sera automatiquement le(la) délégué(e) officiel(le) de la Section à la Conférence Nationale Annuelle.

(2) Le Comité Exécutif désignera, à une réunion précédant la Conférence Nationale Annuelle, une somme d'argent à être assignée au(à la) Président(e) ou son(sa) délégué(e) afin de couvrir les dépenses pour assister à la Conférence.

Section 8 - Responsabilités des Officiers

(1) Le(la) Président(e):
a) présidera toutes les Assemblées de la Section;
b) sera un des deux signataires pour la Section;
c) sera le(la) délégué(e) officiel(le) à la Conférence Nationale Annuelle;
d) soumettra des rapports écrits à la Conférence Nationale Annuelle et à l'Assemblée Générale Annuelle de la Section, détaillant les activités de la Section durant l'année;
e) sera un des vice-présidents nationaux, à moins de changements dans la Constitution Nationale;
f) aura le pouvoir de délégation de tâches et de responsabilités, à sa discrétion, pour les intérêts de la Section.

(2) Le(la) Vice-Président(e):
a) présidera toutes les assemblées de la Section en l'absence du(de la) Président(e);
b) assumera le poste de Président si le(la) Président(e) devient Président National;
c) aidera le(la) Président(e) à accomplir les activités de la Section;
d) présidera le comité de l'éducation.

(3) Le(la) Secrétaire:
a) détiendra tous les dossiers de la Section;
b) rédigera le procès-verbal de toutes les assemblées de la Section;
c) s'occupera de toute la correspondance de la Section;
d) distribuera, à tous les Membres, les procès-verbaux des réunions de l'exécutif ainsi que des Assemblées Générales de la Section.

(4) Le(la) Trésorier(ère):
a) sera un des deux signataires de la Section;
b) recevra et déposera les fonds de la Section au compte de la Section;
c) tiendra les livres;
d) présidera le comité de l'adhésion;
e) collectionnera les frais d'adhésion, émettra des reçus, et soumettra la part due au National;
f) soumettra un rapport écrit à chaque réunion de l'exécutif et à chaque Assemblée Générale Annuelle.

(5) Les Conseiller(ère)s:
a) seront membres du comité de l'éducation, et seront responsables, envers le président du comité, de fournir le contenu et les conférenciers pour la Conférence Educationnelle Annuelle de la Section;
b) seront membres du comité de l'adhésion, afin de recruter des nouveaux membres, et de retenir les membres actifs;
c) tiendront les Membres au courant des activités de la Section.

(6) Le(la) Président(e)-sortant(e):
a) présidera le comité des nominations. Afin d'assurer que tous les postes seront comblés, le comité des nominations présentera une liste de noms pour chaque poste à combler, après avoir obtenu le consentement des candidats.
b) co-présidera le comité de l'adhésion, aidant à recruter des nouveaux membres, et à retenir les membres actifs;
c) développera et maintiendra une trousse d'adhésion pour les nouveaux membres.

Section 9 - Comité Exécutif de la Section

(1) Le(la) Président(e), le(la) Président(e)-sortant(e), le(la) vice-Président(e), le(la) Secrétaire, le(la) Trésorier(ère) et les Conseiller(ère)s formeront ensemble le Comité Exécutif de la Section.

Les réunions se tiendront à l'appel du(de la) Président(e) ou à la demande écrite de quatre (4) membres du Comité Exécutif. Il y aura au moins 3 réunions du Comité Exécutif entre les Assemblées Générales Annuelles. Une ou plusieurs de ces réunions pourront se faire par téléconférence Des réunions seront tenues pour s'occuper des affaires de la Section, incluant la révision des comptes à payer. Aux réunions du Comité Exécutif, les président(e)s de chaque comité présenteront un rapport écrit sur les activités des comités.

Section 10 - Assemblées Générales

Toute Assemblée Générale - le quorum sera 25% des membres.

Des Assemblées Générales seront tenues afin de dispenser des affaires de la Section, et, dans le cas de l'Assemblée Générale Annuelle, pour élire les officiers.

Section 11 - Quorums

Réunions du Comité Exécutif - un quorum pour les réunions du Comité Exécutif sera une majorité des ses membres, et la majorité devra être maintenue pendant la durée de la réunion.

Section 12 - Procédures de vote

Chaque membre ayant droit de vote d'après la Constitution et les Règlements de l'Institut Canadien des Inspecteurs en Santé Publique aura un vote et sera éligible pour être élu officier. Le(la) Président(e) ne votera pas sauf pour briser une égalité. Les membres non-présents pourront voter par procuration sur les changements aux règlements. À l'Assemblée Générale Annuelle, le(la) Président(e) nommera au moins deux compteurs officiels, si nécessaire, afin de dépouiller les votes et aviser le(la) Président(e) des résultats de l'élection.

Section 13 - Points non couverts

Tous les points de procédure non couverts par ces règlements seront gouvernés par la Constitution et les Règlements de l'Institut Canadien des Inspecteurs en Santé Publique.

Section 14 - Changements aux Règlements

Les Règlements ne seront pas changés sauf à une Assemblée Générale Annuelle.

Les projets de changements aux Règlements seront envoyés aux membres 30 jours avant une Assemblée Générale Annuelle.

Les votes par procuration seront utilisés afin que chaque membre puisse se faire entendre.

Une majorité de 75% des membres votant est requise pour accepter un changement.

Section 15

Toutes les motions passées de la Section du Nouveau-Brunswick qui sont en conflit avec ces Règlements sont annulées par la présente.
